    Terms of Service

    These Terms of Service (“Terms”) govern your access to and use of aviator.aero and the websites, newsletters, databases, software, data, research, alerts, reports, APIs, and other products and services provided by Aviator (collectively, the “Services”).

    By accessing, subscribing to, purchasing, or using the Services, you agree to these Terms. If you do not agree, you should not use the Services.

    1. The Aviator Service

    Aviator provides commercial aviation news, data, research, market information, analysis, alerts, and related information services.

    Information available through Aviator may come from Aviator’s research as well as third-party, public, proprietary, automated, and other sources.

    While we make reasonable efforts to provide accurate and timely information, we do not guarantee that information provided through Aviator is accurate, complete, current, error-free, or suitable for any particular purpose.

    Aviation and financial information can change rapidly, and information obtained from third parties, public sources, automated systems, aircraft tracking systems, regulatory sources, company announcements, and market sources may contain errors, omissions, or delays.

    Aviator is an information service. Nothing provided through the Services constitutes financial, investment, legal, tax, operational, safety, regulatory, or other professional advice. You are responsible for independently verifying information before relying on it or making decisions based upon it.

    2. Your Right to Use Aviator

    Subject to these Terms and payment of applicable subscription fees, Aviator grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable right to use the Services for your own personal or authorized internal business purposes.

    Commercial organizations and professionals may use Aviator information for legitimate internal business research, analysis, decision-making, and related activities consistent with their subscription.

    A subscription provides access to Aviator. It does not transfer ownership of Aviator’s content or data or grant you redistribution, resale, syndication, or other commercial exploitation rights.

    Rights granted to organizations with multiple users are subject to the applicable subscription plan or separate written agreement with Aviator.

    Business and Professional Use. Aviator is primarily intended for businesses and aviation industry professionals. If you access or subscribe to the Services on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms. In that case, references to “you” include that organization.

    3. Content, Data and Prohibited Uses

    Except where expressly identified otherwise, Aviator’s content, databases, datasets, research, analysis, newsletters, compilations, graphics, software, interfaces, classifications, summaries, and other proprietary materials are owned by or licensed to Aviator and are protected by applicable intellectual-property laws.

    You may use this information internally as permitted by your subscription. Unless expressly permitted by your subscription or authorized by Aviator in writing, you may not:

    • reproduce, republish, redistribute, syndicate, resell, sublicense, or commercially exploit Aviator content or data;
    • systematically download, export, extract, harvest, or collect Aviator content or data, except through download or export features expressly provided by Aviator;
    • scrape, crawl, spider, or use bots, automated agents, scripts, browser automation, or similar technologies to access or extract information from the Services;
    • create, populate, supplement, or maintain a database, dataset, directory, news service, intelligence product, or competing information service using Aviator content or data;
    • incorporate Aviator content or data into a product, platform, newsletter, website, application, API, data feed, or service provided to third parties;
    • use Aviator content or data to train, fine-tune, ground, evaluate, augment, or develop an artificial intelligence or machine-learning model, large language model, retrieval system, or similar technology without our written authorization;
    • circumvent access controls, rate limits, paywalls, authentication mechanisms, or other technical restrictions;
    • share account credentials or provide unauthorized access to another person or organization; or
    • use the Services in violation of applicable law or another person’s rights.

    These restrictions do not prevent an authorized subscriber from using Aviator information in the ordinary course of its own internal business activities.

    Organizations wishing to redistribute, integrate, syndicate, license, or otherwise use Aviator content or data externally should contact Aviator regarding an appropriate commercial license.

    All rights not expressly granted under these Terms are reserved by Aviator.

    4. Accounts and Security

    You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account.

    Individual accounts may not be shared. Multi-user access is permitted only where provided by the applicable subscription or another written agreement with Aviator.

    You should promptly notify Aviator if you believe your account has been compromised or used without authorization.

    We may suspend or restrict accounts that we reasonably believe have been compromised, shared without authorization, or used in violation of these Terms.

    5. Subscriptions, Renewals and Payments

    Paid subscriptions are billed according to the price and billing period presented when you subscribe or as otherwise agreed in writing.

    Unless otherwise stated or you have elected an invoiced arrangement, paid subscriptions automatically renew for successive periods of the same duration until canceled.

    Where applicable, Aviator will provide advance notice of renewal in accordance with applicable law.

    By maintaining a paid subscription, you authorize Aviator and its payment processor to charge your payment method for applicable subscription fees, taxes, and authorized charges when your subscription renews.

    You may prevent a subsequent renewal by canceling before the renewal date using the cancellation method provided by Aviator or by contacting us.

    Except where required by applicable law or otherwise agreed in writing, payments and subscription fees are non-refundable.

    Cancellation, renewal, refund, and withdrawal rights may vary depending upon your jurisdiction. Where applicable law provides rights that cannot be waived by contract, those rights will apply.

    Aviator may change its plans, features, and pricing from time to time. Changes to the price of an existing subscription will ordinarily take effect upon a subsequent renewal unless otherwise disclosed.

    6. Third-Party Information and Services

    Aviator may display or incorporate information originating from third parties and may link to third-party websites, platforms, databases, or services.

    We do not control and are not responsible for the accuracy, completeness, availability, policies, products, or services of third parties. The inclusion of third-party information or links does not necessarily constitute an endorsement.

    Certain Aviator products may also depend upon third-party data feeds, networks, APIs, or infrastructure. Those services may experience interruptions, delays, inaccuracies, or changes outside Aviator’s control.

    7. Specialized Products and Data

    Certain Aviator products, features, APIs, datasets, or services may be subject to additional terms, usage restrictions, licenses, or disclaimers presented with those products.

    Aircraft positions, tracking information, geofencing results, alerts, operational information, ADS-B data, NOTAM-related information, squawk information, AOG indications, and similar information may be delayed, incomplete, unavailable, or inaccurate.

    Unless Aviator expressly states otherwise in writing, such information is provided for informational purposes and must not be relied upon for aircraft navigation, flight safety, dispatch, air traffic control, regulatory compliance, emergency response, or other safety-critical purposes.

    8. Disclaimers and Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND ALL INFORMATION, DATA, CONTENT, SOFTWARE, ALERTS, REPORTS, AND OTHER MATERIALS AVAILABLE THROUGH AVIATOR ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

    Aviator disclaims, to the extent permitted by law, warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and uninterrupted operation.

    You use and rely upon the Services at your own risk.

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVIATOR AND ITS OWNERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, DATA, GOODWILL, INVESTMENT VALUE, OR BUSINESS OPPORTUNITY ARISING FROM OR RELATED TO THE SERVICES.

    To the maximum extent permitted by law, Aviator’s total aggregate liability arising from or relating to the Services or these Terms will not exceed the amount you paid to Aviator during the 12 months immediately preceding the event giving rise to the claim.

    These limitations apply regardless of the legal theory asserted and even if Aviator has been advised of the possibility of such damages.

    Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

    9. Suspension and Termination

    Aviator may suspend, restrict, or terminate access to the Services if we reasonably determine that you:

    • violated these Terms;
    • failed to pay applicable fees;
    • shared or compromised an account;
    • scraped or systematically extracted Aviator data;
    • redistributed or commercially exploited Aviator content without authorization;
    • infringed Aviator’s intellectual-property rights; or
    • used the Services in a manner that threatens their security, integrity, or availability.

    Serious violations may result in immediate termination.

    Termination does not waive any rights or remedies relating to conduct occurring before termination. Provisions concerning intellectual property, prohibited uses, disclaimers, liability, governing law, and other provisions that by their nature should survive will remain effective after termination.

    10. Governing Law, International Use and Disputes

    These Terms and any dispute arising from or relating to the Services are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles.

    To the extent permitted by applicable law, you and Aviator agree that any legal action or proceeding arising from or relating to these Terms or the Services will be brought exclusively in the applicable state courts located in Hays County, Texas, or the applicable federal court having jurisdiction over Hays County, Texas, and each party consents to the personal jurisdiction and venue of those courts.

    Aviator operates from the United States and makes its Services available to customers in multiple countries. If you access or purchase the Services from outside the United States, you are responsible for complying with laws applicable to your use of the Services in your jurisdiction.

    Prices, taxes, payment methods, subscription rights, cancellation rights, and availability of certain Services may vary by country or region.

    Nothing in these Terms is intended to exclude, restrict, or modify any mandatory rights or remedies that cannot lawfully be excluded, restricted, or modified under applicable law. If mandatory law applicable to you conflicts with these Terms, that law will apply only to the extent required by law.

    11. Changes to These Terms

    Aviator may update these Terms from time to time.

    Updated Terms will be posted on the Aviator website with a revised “Last Updated” date. Where required by applicable law, or where we determine a change is material, additional notice may be provided.

    Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

    12. General Terms and Contact

    If any provision of these Terms is determined to be invalid or unenforceable, it will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.

    Aviator’s failure to enforce a provision does not waive its right to enforce that provision later.

    These Terms, together with any applicable order form, subscription agreement, enterprise agreement, privacy policy, product-specific terms, or other agreement incorporated by reference, constitute the agreement governing your use of the Services.

    If a separately executed written agreement between Aviator and a customer conflicts with these Terms, the separately executed agreement will control to the extent of the conflict.

    Aviator respects your privacy and is committed to protecting the personal information entrusted to us.

    This Privacy Policy explains how Aviator collects, uses, stores, and discloses personal information when you visit aviator.aero, create an account, subscribe to our publications, purchase or use our products and services, communicate with us, or otherwise interact with Aviator (collectively, the “Services”).

    Aviator does not sell your personal information, does not provide it to third parties for their own marketing purposes, and does not use it for behavioral advertising. We disclose information only as necessary to operate and provide our Services, process payments, maintain security, comply with law, and for the other limited purposes described in this Privacy Policy.

    By using the Services, you acknowledge the practices described in this Privacy Policy.

    1. Information We Collect

    The information we collect depends on how you interact with Aviator and may include:

    Account and contact information, such as your name, email address, company, job title, username, and other information you provide when creating or managing an account.

    Subscription and transaction information, such as your subscription plan, billing status, transaction history, and information necessary to administer your subscription.

    Payment card information may be collected and processed directly by our payment processor. Aviator does not need to store complete payment card details where payments are processed by a third-party payment provider.

    Communications, including information you provide when contacting us, responding to emails, requesting support, participating in surveys, or otherwise communicating with Aviator.

    Usage and technical information, which may include IP address, browser and device information, operating system, pages visited, referring pages, approximate location derived from IP address, timestamps, and information about interactions with the Services. We use this information for website analytics, security, fraud prevention, performance monitoring, and service improvement, not for behavioral advertising.

    Email activity, which may include subscription preferences and, where supported by our email systems, information regarding delivery, opens, clicks, and other interactions with Aviator communications.

    Information you voluntarily provide through forms, account settings, requests, or other interactions with the Services.

    2. How We Use Information

    We use personal information as reasonably necessary to:

    • provide and operate the Services;
    • create and administer accounts;
    • process and manage subscriptions and payments;
    • deliver newsletters, alerts, reports, and other requested communications;
    • personalize and improve the Services;
    • provide customer support;
    • communicate about accounts, subscriptions, renewals, security, and service changes;
    • send marketing or promotional communications where permitted by applicable law;
    • understand how the Services are used and improve their performance;
    • maintain security and prevent fraud, abuse, unauthorized access, scraping, and other misuse;
    • enforce our Terms of Service and protect Aviator’s rights;
    • comply with applicable legal and regulatory requirements; and
    • establish, exercise, or defend legal claims.

    We limit our collection and use of personal information to purposes reasonably related to operating, improving, securing, and providing Aviator and our business.

    3. How We Share Information

    Aviator does not sell personal information. Aviator does not share personal information for cross-context behavioral advertising or use personal information for behavioral advertising.

    We do not provide personal information to third parties for their own unrelated marketing or commercial purposes.

    We may provide limited personal information to service providers that process information on our behalf and help us operate Aviator. These include providers of:

    • payment processing and billing;
    • accounting and financial administration;
    • email and business communications;
    • website hosting and infrastructure;
    • security and fraud prevention;
    • website traffic measurement and analytics; and
    • professional services, including legal and accounting services.

    These service providers receive information only as reasonably necessary to perform services for Aviator and are subject to applicable contractual and legal obligations.

    For example, subscription payments may be processed by [Stripe](https://stripe.com?utm_source=chatgpt.com), while other billing or accounting functions may be administered using [QuickBooks](https://quickbooks.intuit.com?utm_source=chatgpt.com). Aviator does not need to store complete payment-card information when payments are processed by a payment provider.

    A current list of material service providers that process personal information on our behalf is available upon request.

    We may also disclose information where required by applicable law, regulation, subpoena, court order, or other valid legal process, or where reasonably necessary to protect Aviator, our users, or others from fraud, abuse, security threats, or unlawful activity.

    If Aviator is involved in a merger, acquisition, financing, reorganization, sale of assets, or similar business transaction, information may be transferred as part of that transaction subject to applicable law.

    4. Cookies and Analytics

    Aviator does not use cookies for behavioral advertising or cross-site tracking.

    We may collect limited technical and usage information to understand website traffic, maintain security, prevent abuse, and improve the performance of our Services. This may include information such as IP address, browser and device information, pages visited, referring pages, and approximate location derived from IP address.

    Aviator does not use this information to create advertising profiles or serve behavioral advertising.

    Certain infrastructure, analytics, and security providers may use cookies or similar technologies that are necessary or appropriate to provide, measure, protect, or secure the Services.

    Where applicable law requires consent for non-essential cookies or similar technologies, Aviator will provide appropriate choices or obtain consent as required.

    5. Email Communications

    If you subscribe to Aviator newsletters, alerts, marketing communications, or similar emails, you may unsubscribe at any time using the unsubscribe link included in applicable communications or by contacting us.

    You may continue to receive transactional or administrative communications necessary to operate your account or subscription, such as billing, security, account, or service notices.

    6. Data Retention

    We retain personal information for as long as reasonably necessary to provide the Services, maintain your account, fulfill the purposes described in this Privacy Policy, comply with legal and accounting requirements, resolve disputes, prevent fraud and abuse, and enforce our agreements.

    Retention periods may vary depending on the type of information and the reason it was collected.

    Aviator operates from the United States and provides Services to customers throughout the world.

    Where applicable law requires safeguards for international transfers of personal information, Aviator will use appropriate mechanisms or safeguards required by applicable law.

    Aviator is a business and professional information service and is not directed to children.
